Adults Shouldn’t Be Punished For Sharing Cannabis, Maltese NGO Urges

A Maltese NGO is urging authorities to repeal an “outdated and stigmatising” law that aids the arrest and prosecution of citizens for sharing cannabis.

“Our proposal advocates for the abolition of legal action for the sharing and gifting of cannabis among consenting adults without any monetary transactions, aligning with the ethos of the recent partial decriminalisation amendments,” Releaf Malta said in an official statement. 

The organisation argued that this proposed amendment is pivotal in safeguarding communities against unwarranted persecution, in harmony with the fundamental principles of harm reduction and social justice endorsed by government authorities.

It stated that the existence of these laws is contradictory to the principles advocated by the state, undermining the credibility, core values, and objectives of the reforms initiated which partially decriminalised the plant.

“The current legal framework fosters stigma and disproportionately penalises individuals interacting in responsible non-commercial cannabis sharing or gifting. Urgent reform is essential to rectify this imbalance, ensuring legal measures align with collective viewpoints and principles of fairness and equity.”

Failure to address this, Releaf said, perpetuates a disconnection between legislative mandates and community values, threatening the credibility of reforms aimed at promoting social justice.

Subsequently, there is an urgent need for immediate action by the state to rectify these incompatibilities within the legislative framework.

“The urgency lies in aligning laws with the progressive and inclusive principles advocated by civil society and the government’s own commitment to justice and fairness.”

Malta’s first two cannabis clubs were given operational licenses in October and these can grow and distribute marijuana to their members.
