‘He Is Fighting For His Life In Court’: Yorgen Fenech’s PAC Testimony Suspended Due To Ongoing Cases
The long-awaited Public Accounts Committee (PAC) hearing which was set to feature Yorgen Fenech’s testimony in relation to the ongoing NAO investigation has been suspended.
Represented by lawyers Charles Mercieca and Gianluca Caruana Curran, they requested the suspension of Fenech’s testimony until the criminal proceedings are concluded.
Fenech’s lawyers are arguing that since the outcome of his criminal case is still pending, the testimony should not happen at this moment in time: “He is fighting for his life in court”.
Citing Erskine May, “as well as the rulings of the Speaker of 25th November 2019, 26th November 2019, and 16th June 2020, the committee is being asked that at this stage, pending the outcome of the proceedings presently sub judice, it does not hear the testimony of Fenech,” Mercieca said while verbalising the request.
The committee accepted the request.
Before Fenech exited the room, PAC Chairperson Darren Carabott told him that “if the cases are concluded during this legislature and I am still chair, we will certainly summon you to testify”..
The committee is currently discussing the Auditor General’s investigation of a controversial contract awarded by Enemalta to Electrogas.
Fenech was summoned during the last hearing by Carabott, after he put forward a request for Fenech to testify in its next sitting – to which there were no objections.
Meanwhile, the PAC hearings of the former chief of staff Keith Schembri had to be suspended after Schembri filed a constitutional case following a report which was made alleging perjury.
Fenech is the main alleged suspect, accused of masterminding in Daphne Caruana Galizia’s murder case.
