Lilu King’s Lawyers Warn Extradition To Libya Could Result In Torture – Or Death

According to Lilu King’s legal team, Mohamed Ali Ahmed Elmushraty, widely known as Lilu King, would likely face torture or even death if extradited to Libya, as stated in a note filed on Tuesday.

Lilu King is currently facing criminal charges in Malta, including money laundering, tax evasion, and participation in an organised crime group, following his arrest last month.

During a court hearing on Monday, an inspector from the Police’s Interpol section revealed that Libya has requested Elmushraty’s extradition, citing serious charges such as murder and drug trafficking.

It was emphasised that Libya’s intention to seek his extradition must be understood in the context of his refugee status in Malta.

The defence team, consisting of lawyers Franco Debono, Marion Camilleri, and Francesca Zarb, stressed that Elmushraty had been granted refugee status due to “persecution” he faced in Libya.

They argued that Libya, being an unstable country engulfed in a civil war since 2011, raises concerns about the fairness of any potential trial.

In their note, the lawyers highlighted the European Convention on Human Rights, which Malta has signed and ratified, and which guarantees protection against torture and inhuman or degrading treatment.

They asserted that if extradition were to proceed, Elmushraty would not only be denied a fair trial but also face a “real possibility” of torture or even death.
