Pending Decision Could Lead To The Approval Of Yorgen Fenech’s Bail In The Coming Days
Ongoing Court discussionscould potentially result in the granting of bail to Yorgen Fenech, today or in subsequent days.
Fenech, who’s facing accusations of complicity in the murder of Daphne Caruana Galizia, has been held in custody since 2019.
Since then, he had requested bail on multiple occasions, with the most recent argument earlier last December made by his lawyers highlighting that as per Article 575 of the Criminal Code, he should be granted bail once 30 months passed from when his bill of indictment was issued.
Well over 30 months had passed since the defence’s argument was made, however, the Prosecution as well as the Attorney General heavily opposed the request, arguing in a written reply that the 30-month time limit was paused when additional witnesses testified before the Magistrates’ Court during the reopened evidence compilation.
Recently, Monica Fenech, the aunt of Fenech, told the Court she is willing to act as his guarantor if he is granted bail, suggesting that, if released on bail, Yorgen could live in a house across the road from her own.
However, today, a session was scheduled that saw further arguments on Fenech’s bail application, with media reporting that an ongoing discussion could potentially lead to the bail’s approval.
The prosecution team includes Attorney General lawyers Anthony Vella, Godwin Cini, and Danika Vella. Lawyers Gianluca Caruana Curran, Charles Mercieca, and Marion Camilleri represent the defense, while Andrew Borg Cardona and Jason Azzopardi appear as parte civile.
