St Julian’s Midnight Construction Deemed Illegal By BCA – Even Though Transport Malta Green Lit It

The Building and Construction Authority has taken action after private construction works were permitted to take place between 11am and 5am in St Julian’s.

The investigation took off after Lovin Malta published videos showing works taking place at ungodly hours, awakening various residents from their sleep. 

Videos sent to Lovin Malta by two different neighbours residing along Triq l-Mrabat and Triq Birkirkara in St Julian’s depict disruptive works being carried out between 11pm and 5am – and the permit for these works was granted by Transport Malta.

“You are kindly being informed that after the Building and Construction Authority received a report that construction works were being carried out outside the legally permissible hours, the Authority immediately investigated the case and concluded that construction works were being performed during the night causing a disturbance in the neighbourhood,” a spokesperson for the BCA told Lovin Malta.

“As a result, the Authority issued a penalty for work that was taking place illegally at times not permitted by law.”

“The law that clearly indicates the permissible hours during which construction work can take place is found in the Construction Management Site Regulations.”

“No construction activity can be carried out before 7am, after 8pm, and at any time on Sundays and public holidays.”

However, Lovin Malta also enquired on whether any action was taken against Transport Malta for granting the permit in the first place. 

“If Transport Malta thinks that it acted according to its rules, then we cannot intervene,” the BCA responded.

It assured that the BCA will continue to pay close attention to construction sites and remind contractors and developers to maintain good housekeeping and work within permissible hours.
