Maltese Man Accused Of Domestic Violence Cleared Of All Charges – In Line With Victim’s Wishes

A woman who accused her partner of domestic violence changed her mind and begged the Maltese courtroom to let him off the hook.

Apart from being accused of causing his partner to fear violence, slightly injuring her, and insulting and threatening her, the criminal was also charged with breaching the bail conditions of a previous release over other crimes.

”The man also stood charged with breaching the bail conditions of a previous release since he is on bail awaiting trial over another crime,” a court representative stated.

Under oath, the woman refused to provide evidence against him and stated that she forgave her partner, reiterating that he should still be allowed to father his children because they need his presence in their lives – despite the fact that the man was also charged with causing his two boys to fear violence.

Magistrate Abigail Critien contemplated proceeding with the trial; according to the law, the police could proceed ex officio. However, she also considered that the law allows for clemency to triumph over justice, in cases where the victim expresses and shows such interest.

The magistrate stated that although the charges against the man are noteworthy, his partner showed no interest in continuing with the case, therefore, made the decision to acquit him from all charges.

Police inspector Omar Zammit prosecuted. Lawyer Jacob Magri appeared for the woman. Lawyers Franco Debono and Marion Camilleri represented the man.
