A 35-year-old Italian woman and mother of two has been sentenced to three years in jail after she was found guilty of producing child pornography of her own two children, going so far as to print pictures of her naked children and share them with her colleagues.

The woman, whose name is subject to a court ban to protect the children, was reported to the police by social welfare agency Appogg after the organisation was notified that she had been showing her colleagues photos of her nude children along with her ex-husband. The mother worked as a teacher. 

The mother claimed that the photos were meant to be used against her ex-husband during separation proceedings, showing he was not suitable to be around children as he used to walk around the house naked.

The woman, who works at a Maltese school, claims to have sought her colleagues’ advice on her separation by showing the photos, but the school later flagged this to social services, who later took it to the police.

During court proceedings, some of the photos that were taken, including her children bathing and sleeping, were not deemed to qualify as indecent or pornographic. The mother claimed that the nude photos featuring just the children were taken to show her paediatrician that her children were physically well.

However, there were a few photos in which the children were seen posing erotically and even touching their father’s private parts, which the court classified as child pornography.

A programme used by police and court experts to analyse photographs flagged them as child pornography.

In their reasoning, the court observed that many of the photos were taken before the separation proceedings even started and delegitimised the women’s excuse that she sought her colleague’s advice on marital separation by printing and distributing the photos.

The court found her guilty of possessing child pornography and sentenced her to three years in jail.

Her name was also registered into the sex offenders register and she has been permanently banned from any professional duties which involve direct or regular contact with minors.
