Motorist To Pay €324,000 To Family Of Maltese Victim He Killed While Driving At 140 Km/Hr

A motorist and his insurance company were ordered to pay €323,944 to the family of Stephanie Rapa, who was killed while crossing Triq ix-Xatt, Gżira, in an incident back in 2017.

”In the circumstances, the court concludes that the defendant must bear full responsibility for the incident in which Stephanie Rapa lost her life,” a court representative stated.

In 2017, Anthony Chircop was driving at 140 km/hr, and ended up killing the pharmacist – to this day, he still denies that he was driving in such a haphazard manner.

The car had thrown the victim into the air at a height of three metres, the court heard.

Rapa’s family filed a civil case against the motorist and he has finally been found guilty of involuntarily murder.

”This court has no doubt that dangerous driving was the proximal cause of the incident in which Stephanie Rapa lost her life. At a speed of 140 km/hr, the defendant placed himself in a position where he was unable to avoid the incident,” a court member said.

”Furthermore, the evidence shows that shortly before the incident occurred, the defendant had made use of a special feature of his vehicle to increase its speed.”

The court reached the conclusion the incident happened solely due to the fact that Chircop was driving recklessly. 

The Court of Appeal ordered Chircop to give the Rapa family €324,944 in damages, together with the costs of the first instance and the appeal.

Lawyers Joe Giglio and Sarah Mifsud represented the family of the victim in the proceedings, while lawyers Christine Calleja and Kirk Brincau assisted Chircop.
