Naxxar Man Beat Up Neighbour And Caused Him Permanent Disability Over Urine-Feud
A Naxxar man has been found guilty of beating up his neighbour and causing him to sustain a 6% permanent disability from an argument that stemmed from leftover urine.
Alexander Mifsud, 42, had bad blood with his neighbour, with Mifsud allegedly spitting on the ground whenever the pair crossed paths, TVM reported.
Around five years ago, the tension rose to the point that Mifsud allegedly tried to punch his neighbour and the victim, in turn, defended himself by punching Mifsud in the face.
The accused then dragged the victim, threw him on the ground and began kicking him with his safety shoes on.
Consequently, the victim sustained a 6% permanent disability according to a doctor who presented an official certificate in court.
According to the victim, he would always find urine next to his garage which was situated near the accused’s residence. When the victim approached Mifsud about it, he began spitting on the ground every time the two passed each other.
Meanwhile, Mifsud testified that he attempted to speak calmly with his neighbour but the latter punched him in the eye. Therefore, he insisted that he only tried to defend himself.
However, Magistrate Claire Stafrace Zammit said that Mifsud suffered from no injuries following the altercation, while the victim sustained grievous ones.
She thus found Mifsud guilty of grievously injuring his neighbour, and sentenced him to two years in jail, suspended for four years. She further issued a restraining order so that Mifsud can no longer harass his neighbour.
