Rival Tenderer Files Fresh Appeal Over Magħtab Waste Incinerator

Two companies that tendered for the construction of a waste incinerator in Magħtab has filed a fresh court appeal against the government, The Shift News has reported.
Recently, Wasteserv re-recommended that the €600 million tender be issued to a consortium composed of the Bonnici Brothers and French recycling company Paprec.
This was a few months after the Appeals Court ruled that the tender had to be re-adjudicated due to some members of the adjudicating panel having a conflict of interest.
Rival tenderers Kandevia Inova AG (formerly Hitachi) and Terna SA have now filed a fresh appeal through their lawyers Adrian Delia and Matthew Paris.
They are now accusing the government of a number of legal infringements to favour the winning tenderer.
The companies warned that Wasteserv failed to follow the court decision that told them to restart the evaluation process from scratch.
They are requesting that the Public Contracts Review Board scrap Wasteserv’s recommendation, order a new reevaluation or cancel the tender entirely.
They warned that they could file a fresh case in front of the Court of Appeal if their request isn’t granted.
