Watch: Malta Launches New Detailed Rules To License Demolition, Excavation And Construction Contractors
New detailed rules to license construction contractors have been launched for public consultation.
Planning Minister Stefan Zrinzo Azzopardi this afternoon announced plans to set up a new board that will issue three different licenses for demolition, excavation and construction contractors and have the power to suspend and revoke them.
All contractors will need to be at least 18 years old and present a clean police conduct, a VAT number (where applicable) and a declaration that they aren’t bankrupt.
These are the proposed criteria in detail:
1. Licensing of Demolition Contractors:
They must display prior competence in demolition work, dismantling of structural and non-structural elements, debris separation and separate storage, correct truck loading, shoring techniques, basic legal requirements, and basic health and safety standards.
-If the applicant is an individual, they must be certified as a Level 4 Demolition Plant Supervisor and have at least two years experience in demolition works. Alternatively, they can have a minimum of three years’ experience in demolition works supporters by references of at least two periti. They must also present a list of all certified equipment to be utilised.
-If the applicant is a company, they must show that they themselves or at least one full-time employee is a Level 4 Certified Demolition Plant Supervisor. All demolition works must be supervised by a person with that qualification level, and unskilled construction employees will only be allowed on site under their constant supervision.
2. Licensing of Excavation Contractors
-They must display prior competence in excavation work, setting up and dismantling of structural and non-structural elements, correct truck loading, shoring techniques, dumping of material to approved dumping sites, basic legal requirements, and basic health and safety standards.
-Should they intend to carry out piling works, they must also display competence in the shifting of piling equipment, boring or boring of piles, casting of piles, and pile cap construction.
-If the applicant is an individual, they must be certified as a Level 4 Excavation Plant Supervisor and have at least two years experience in demolition works. Alternatively, they can have a minimum of three years’ experience in excavation works supporters by references of at least two periti. They must also present a list of all certified equipment to be utilised.
-If the applicant is a company, they must show that they themselves or at least one full-time employee is a Level 4 Certified Excavation Plant Supervisor. All excavation works must be supervised by a person with that qualification level, and unskilled construction employees will only be allowed on site under their constant supervision.
3. Licensing of Construction Contractors
-They must display prior competence in masonry and brick wall construction, design and construction of formwork, reinforcement of concreting works, site management, overseeing site preparation, basic legal requirements, and basic health and safety standards.
-If the applicant is an individual, they must possess a mason’s license and equivalent National Occupational Standards Certificate in masonry works, and present a list of all certified equipment to be utilised.
-If the applicant is a company, they must show evidence of at least three years experience in construction management supported by references from at least two periti. They must also employ at least one licensed mason, at least one Level 3 certified block layer, at least one Level 2 certified assistant block layer, and present a list of all certified equipment to be utilised.
Public consultation will run until 21st April, and the plan is for the BCA to start accepting applications on 1st June. Regulation will formally kick in on 1st November, but contractors won’t be able to operate between June and November unless they receive previsionary clearance.
By the start of 2025, no contractor will be allowed to work unless they have obtained a license.
