Unclear If Criminal Defendant ‘Insulted And Threatened’ Attorney General Lawyer At Valletta Bar

Andrea Zammit – a prosecutor from the office of the Attorney General – took to the witness stand on Tuesday in criminal proceedings against Josef Majri from Tarxien.

Zammit claimed that Majri had insulted and threatened him when they happened to be at the same Valletta bar on the 20th May.

At the time of their coincidental meeting, Majri was on bail release over two sets of criminal proceedings, both of which are being prosecuted by Zammit.

These criminal proceedings have been brought after nine kilos of weed were found in his car in 2019, and he is also facing separate accusations from 2021, for having laundered illicitly earned money.

Allegedly, when they happened across one-another at the bar,  the defendant recognised the prosecutor, and directed a threatening sign towards the lawyer by gesturing with his thumb and index finger.

Two days later, when Zammit filed a police report, Majri was arraigned.

According to Zammit’s testimony, he had been at a bar with a colleague when he spotted Majri, who also noticed him.

Zammit said that Majri gestured with his thumb and index finger extended in his direction.

Zammit did not think much of it initially, but filed a police report on Monday afternoon. 

This delay, and an apparent inconsistency between the police report and Zammit’s testimony, prompted questions from Majri’s defence Lawyer Franco Debono – who read out the police report.

It said that Zammit had seen Majri making a hand signal, and they recognised each other.

The report did not state that Zammit felt threatened.

Zammit later told the court that he called up and informed magistrate Donatella Frendo Dimech about the incident. Frendo Dimech is presiding over Majri’s drug case.

Zammit stressed that he did not to so in an attempt to influence the case, but because he “he feared for his safety”.

Debono’s cross-examination focused around a pivotal question:

Had Zammit changed his stance from not feeling threatened to feeling threatened ?

Zammit denied that this was the case.

One of Zammit’s colleagues, Sean Xerri De Caro, also gave testimony during this hearing. He had been asked to join Zammit for a social event. 

As they were leaving the bar together, Xerri De Caro and Zammit noticed a group of men drinking near the entrance.

Xerri De Caro recalled seeing someone pointing in the direction of someone behind him – presumably Zammit – and added that his initial impression was that the pointer had recognised someone.

Zammit was being driven home by Xerri De Caro, when Zammit asked about Majri – and told his colleague that the criminal defendant had made a gesture towards him at the bar. 

Franco Debono’s cross-examination of the witness revealed that Zammit did not express fear over the incident, and was simply asking about the gesture.

Franco Debono made a request for Majri’s bail, as he noted that the sergeant’s initial report from two days after the incident made no mention of Zammit feeling threatened.

Debono claimed to be was surprised by Zammit’s testimony, and that the prosecutor filed a report almost two full days after the incident.

He pointed out that Zammit had initially told the police that Majri had not made him feel threatened, and that this stance had allegedly changed by the time he took to the stand two weeks later.

Majri’s defence also expressed concern about the fact that Zammit had communicated with magistrate Frendo Dimech – presiding over committal proceedings in Majri’s drug case.

Majri was granted bail against a deposit of €1,000 and a €5,000 personal guarantee, despite the defendant having confessed to breaching bail conditions under police interrogation.

Zammit has had a protection order issued in his favour, and Majri has been warned against approaching him.
